OFFICIAL RULES 

1. Sponsor. These are the Official Rules of the American Institute for Foreign Study, Inc.’s Program Discount for Select Study Abroad Programs (the “Program Discount”). The Sponsor of the Program Discount is the American Institute For Foreign Study, Inc. (“AIFS”), 1 High Ridge Road, Stamford, CT 06905. AIFS can be contacted at (203)399-5000. The offer of the Program Discount is subject to these Official Rules.

2. Program Discount. AIFS is offering eligible first-time applicants for its Spring 2024 study abroad programs a $500 Program Discount for enrollment in programs at Select Locations only. A list of these Select Locations is attached to these Official Rules. The $500 Program Discount will be in the form of a credit on the program fee which, after applicant has been accepted into a program at a Select Location and has made the $500 non-refundable deposit, will be applied automatically against the program fee at the Select Location. A Program Discount cannot be transferred or exchanged for cash or other goods or services.

3. Applying For and Eligibility for Program Discount. Only qualified first-time applicants for enrollment in Spring 2024 programs at one of the Select Locations who apply during the period beginning at 12:01 AM EST on August 1 and ending at 11:59 pm EST on September 30, 2023 (the “Program Discount Period”) are eligible for the Program Discount. Applications must be submitted during this Program Discount Period to be eligible for the Program Discount; however, applicants may make their program deposit at any time before the deposit deadline. Each applicant is responsible for determining the corresponding time zone in his or her respective location or locations. The following are not eligible for the Program Discount: the Sponsor’s officers and directors and employees or any individuals involved with the design, production, execution, or distribution of the Program Discount and their immediate family members, meaning spouse, ex-spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister, in-laws or first cousin.  The Sponsor in its sole discretion may require the recipient of a Program Discount to complete a publicity release.

4. Miscellaneous.

a. Applicants and Program Discount recipients unconditionally agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final. The Sponsor reserves the right to disqualify any applicant or recipient who, in its sole suspicion, tampers with the application process, violates these Official Rules, or acts in a disruptive manner.

b. Sponsor reserves the right to cancel or modify the offer of the Program Discount or to alter these Official Rules, provided that no changes will be made contrary to governing law.

c. All applicable federal, state, and local laws apply, and all applicable federal, state, and other taxes, if any, are the sole responsibility of the recipient.

d. The Sponsor and, as applicable, the employees, officers, directors, shareholders, agents, and representatives of the Sponsor, are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible applications; (ii) any condition caused by events beyond the control of the Sponsor that may cause the application process or Program Discount to be disrupted or discontinued, including without limitation any disruption in the World Wide Web; (iii) any injuries, losses, or damages resulting from participation in the Program Discount; (iv) any printing or typographical errors in any materials associated with the application or Program Discount, (v) any inability to apply for a program that any applicant or prospective applicant may experience due to the functioning or non-functioning of any mobile device, tablet, and/or other computer, and (vi) delay in application of the Program Discount.

e. APPLICANTS and RECIPIENTS agree that any dispute RELATING TO THE PROGRAM DISCOUNT and/or these official rules shall be resolved individually without class action and exclusively by the state and federal courts located in CONNECTICUT, without regard to any state’s conflict of laws principles. APPLICANTS and RECIPIENTS FURTHER AGREE THAT (1) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH APPLYING TO A PROGRAM AT A SELECT LOCATION, BUT IN NO EVENT ATTORNEYS’ FEES; AND (2) UNDER NO CIRCUMSTANCES WILL ANY APPLICANT FOR THE PROGRAM DISCOUNT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT or Winner HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL, AND CONSEQUENTIAL DAMAGES, AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.

f. If any provision of these Official Rules is deemed to be invalid or unenforceable, in whole or in part, such provision will be deemed to be modified or restricted to the extent and in the manner necessary to render the same valid and enforceable and these Official Rules will be construed and enforced to the maximum extent permitted by law as if such provision had been originally incorporated herein as so modified or restricted, or as if such provision had not been originally incorporated herein, as the case may be.

g. WAIVER OF LIABILITY AND AGREEMENT TO INDEMNIFY: By applying, each applicant and their heirs, successors and assigns (the “Applicant Party”) thereby releases, forever discharges, and covenants not to make a claim against or sue the Sponsor, together with its parents, subsidiaries, affiliates, licensees, employees, officers, directors, representatives, successors, and assigns (the “Released Parties” or in the singular “Released Party”), of and from all manner of action or actions, cause or causes of action, at law or inequity, suits, claims, demands, liability, loss, cost, or expense, of any nature whatsoever, known or unknown, fixed or contingent, which Applicant Party may have or hereafter have by reason of any injuries or damages Applicant Party may sustain, whether to Applicant Party’s person, property, reputation, or otherwise, as a result of, incident to, or related in any way to applying for the Program Discount, the Program Discount, and/or the use, incorporation, or exploitation of the application for the Program Discount for any purpose described herein. Applicant Party waives and foregoes the right to seek injunctive relief against any Released Party relating in any way to the application for the Program Discount, the Program Discount, and/or the use, incorporation, or exploitation of the application for the Program Discount for any purpose described herein. Applicant Party agrees to indemnify and hold harmless the Released Parties from and against any liabilities, losses, claims, demands, costs (including, without limitation, reasonable attorneys’ fees), and expenses arising in connection with any breach or alleged breach by Applicant Party of any representation made in the application for the Program Discount or by virtue of applying for the Program Discount.

h. The Sponsor makes no warranties or representations concerning the goods and/or services of any third party.
