EURAIL GLOBAL PASS FOR SELECT STUDY ABROAD AND INTERNSHIP ABROAD PROGRAMS

1. Sponsor. These are the Official Rules of the American Institute for Foreign Study, Inc.’s Eurail Global Pass for Select Study Abroad and Internship Abroad Programs ("Eurail Global Pass”). The Sponsor of the Eurail Global Pass is the American Institute For Foreign Study, Inc. (“AIFS Abroad”), 1 High Ridge Road, Stamford, CT 06905, USA. AIFS Abroad can be contacted at (203) 399-5000. The offer of the Eurail Global Pass is subject to these Official Rules.

2. Eurail Global Pass. AIFS Abroad is offering eligible first-time applicants for its Spring 2025 Study Abroad and Internship Abroad programs a Eurail Global Pass for enrollment in programs at Select Locations only. A list of these Select Locations  follows these Official Rules. The Eurail Global Pass will be in the form of a personalized Eurail Pass which, after applicant has been accepted into a program at a Select Location and has paid the $500 non-refundable deposit, will be emailed to each student’s email address with instructions on how to retrieve the Pass. The Eurail Global Pass is valued at $457 USD and cannot be transferred or exchanged for cash or other goods or services. Use of the Eurail Global Pass is subject to such rules and regulations as may be adopted by Eurail from time to time. The Sponsor reserves the right to change the list of Select Locations at any time and from time to time, in its sole discretion. If the Select Location chosen by a recipient is not available, then the Sponsor, in its discretion, reserves the right to work with that recipient to select a substitute Select Location, subject to any written directions from a governmental or regulatory authority.

3. Applying For and Eligibility for Eurail Global Pass. Only qualified first-time applicants for enrollment in AIFS Abroad Spring 2025 Study Abroad and Internship Abroad programs at one of the Select Locations who apply during the period beginning at 12:01 AM EDT on April 29, 2024, ending at 11:59 pm EDT on October 7, 2024 (the “Eurail Global Pass Period”) will be eligible for the Eurail Global Pass. Applications must be submitted during the Eurail Global Pass Period to be eligible for the Eurail Global Pass; however, applicants may make their program deposit at any time before the deposit deadline. Each applicant is responsible for determining the corresponding time zone in his or her respective location or locations. The following persons are not eligible for the Eurail Global Pass: the Sponsor’s officers, directors and employees or any individuals involved with the design, production, execution, or distribution of the Eurail Global Pass and their immediate family members, meaning spouse, ex-spouse, de facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister, in-laws or first cousin.  The Sponsor in its sole discretion may require the recipient of a Eurail Global Pass to complete a publicity release.

4. Miscellaneous.

a. Applicants and Eurail Global Pass recipients unconditionally agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final. The Sponsor reserves the right to disqualify any applicant or recipient who, in its sole suspicion, tampers with the application process, violates these Official Rules, or acts in a disruptive manner.

b. The Sponsor reserves the right to cancel or modify the offer of the Eurail Global Pass or to change these Official Rules, provided that no changes will be made contrary to governing law.

c. All applicable federal, state, and local laws apply, and all applicable federal, state, and other taxes, if any, are the sole responsibility of the recipient of the Eurail Global Pass. Independent financial advice should be sought.

d. The Sponsor and, as applicable, the employees, officers, directors, shareholders, agents, and representatives of the Sponsor, are not responsible for and shall not be liable for: (i) late, lost, delayed, damaged, misdirected, incomplete, illegible, or unintelligible applications; (ii) any condition caused by events beyond the control of the Sponsor that may cause the application process or Eurail Global Pass to be disrupted or discontinued, including without limitation any disruption in the World Wide Web; (iii) any injuries, losses, or damages resulting from participation in the Eurail Global Pass; (iv) any printing or typographical errors in any materials associated with the application or Eurail Global Pass; (v) any inability to apply for a program that any applicant or prospective applicant may experience due to the functioning or non-functioning of any mobile device, tablet, server, and/or other computer; and (vi) any delay in application of the Eurail Global Pass.

e. Applicants and Recipients agree that any dispute relating to the Eurail Global Pass and/or these Official Rules shall be resolved individually without class action and exclusively by the state and federal courts located in the State of Connecticut, USA, without regard to any state’s conflict of laws principles. APPLICANTS AND RECIPIENTS FURTHER AGREE THAT (1) ANY AND ALL CLAIMS, JUDGMENTS, AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS AND EXPENSES INCURRED, INCLUDING COSTS ASSOCIATED WITH APPLYING TO A PROGRAM AT A SELECT LOCATION, BUT IN NO EVENT ANY ATTORNEYS’ FEES; AND (2) UNDER NO CIRCUMSTANCES WILL ANY APPLICANT FOR THE EURAIL GLOBAL PASS BE PERMITTED TO OBTAIN AWARDS FOR, AND EACH APPLICANT AND RECIPIENT HEREBY WAIVE ALL RIGHTS TO CLAIM, ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, EXEMPLARY AND/OR CONSEQUENTIAL DAMAGES, AND/OR ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET COSTS AND EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED.

f. If any provision of these Official Rules is deemed to be invalid or unenforceable, in whole or in part, then such provision will be deemed to be modified or restricted to the extent and in the manner necessary to render the same valid and enforceable. These Official Rules will be construed and enforced to the maximum extent permitted by applicable law as if such provision had been originally incorporated herein as so modified or restricted, or as if such provision had not been originally incorporated herein, as the case may be.

g. WAIVER OF LIABILITY AND AGREEMENT TO INDEMNIFY: By applying for the Eurail Global Pass, each applicant and their heirs, successors and assigns (the “Applicant Party”) thereby releases, forever discharges, and covenants not to make a claim against or sue the Sponsor, together with its parents, subsidiaries, affiliates, licensees, employees, officers, directors, representatives, successors, and assigns (collectively, the “Released Parties” or, individually, a “Released Party”), of and from all manner of action or actions, cause or causes of action, at law or in equity, suits, claims, demands, liabilities, losses, costs, or expenses, of any nature whatsoever, known or unknown, fixed or contingent, which any Applicant Party may have or hereafter have by reason of any injuries or damages that such Applicant Party may sustain, whether to the Applicant Party’s person, property, reputation, or otherwise, as a result of, incident to, or related in any way to the application for the Eurail Global Pass, the Eurail Global Pass, and/or the use or exploitation of the Eurail Global Pass. The Applicant Party waives and foregoes the right to seek injunctive relief against any Released Party relating in any way to the application for the Eurail Global Pass, the Eurail Global Pass, and/or the use or exploitation of the Eurail Global Pass. The Applicant Party agrees to indemnify and hold harmless the Released Parties from and against any and all liabilities, losses, claims, demands, costs (including, without limitation, reasonable attorneys’ fees), and expenses arising in connection with any breach or alleged breach by the Applicant Party of any representation made in the application for the Eurail Global Pass or by virtue of applying for the Eurail Global Pass.

h. The Sponsor makes no warranties or representations concerning the goods and/or services of any third party, including, without limitation, Eurail.
